LOS ANGELES (OC),–Former FBI Director James Comey, 64, sought through his defense attorney Patrick Fitzgerald, to have his charges of obstruction and lying to the Senate Judiciary Committee tossed out.  Comey was FBI Director in 2016 when he opened a counterintelligence investigation into Trump and his campaign alleging ties to the Kremlin.  Comey used former Secretary of State Hillary Rodham Clinton’s bogus Steele Dossier as probable cause, her paid opposition research arranged by former Perkins Cole lawyer Mark Elias. Elias played a key role in Hillary’s 2016 election campaign, using every dirty trick in the books to beat Trump in the general election.  Hillary accused Trump of being a “Putin puppet,” something she announced while debating Trump but contained in her opposition research AKA “The Steele Dossier,” arranged by Elias through the opposition research company FusionGPS.

            Comey was at the center of the controversy, taking Hillary’s Steele Dossier from 70-year-old former CIA Director John Brennan.  Brennan received Hillary’s Steele Dossier from the late Sen. John McCain (R-Az.) a bitter enemy of Trump. When you look at the big picture, Trump’s counterintelligence investigation ran up the White House chain of command to former President Barack Obama, former Vice President Joe Biden, former Atty. Gen. Loretta Lynch and former National Security Adviser Susan Rice, all of whom were using federal intel and law enforcement agencies to sabotage Trump’s campaign.  When Trump became president, he fired Comey May 8, 2017, for his corrupt role in investigating him with bogus charges from Hillary’s dossier.  Trump also dismissed Comey for leaking fake news to the New York Times and Washington Post, both papers opposed to Trump’s election.

            Comey’s attorney are defending him on only two charges involving obstruction of justice and lying to the Senate Judiciary Committee.  “In this case, the facts before the indictments and even comments Trump made after the indictment provide strong factual evidence that Mr. Come is the victim o of either selective or vindictive prosecution,” Gene Rossi, a former 30-year federal prosecutor told CBS News.  CBS has a vested interest in seeing Comey’s case tossed out, largely because they participated in the Russian hoax, reporting for years about Trump’s alleged ties to the Kremlin.  CBS, like th the New York Times and Washington Post, wants Comey’s case tossed out because in vindicates CBS’s collusion with the Obama White House seeking to discredit Trump’s 2016 campaign.  CBS, like ABC and NBC News, were heavily invested in seeing Hillary elected president.

            Comey’s role in the Russian hoax was beyond the pale for any federal law enforcement official.  Democrats and the fake news want Comey vindicated but he was guilty as sin of leaking fake news stories to the press, at the same time, investigating Trump without any probable cause other that using Hillary’s bogus Steele dossier.  Steele admitted in a civil suit that he had “destroyed” all of his sources on which his dossier was based.  More likely he never had any sources at all, just fabricated the whole document.  Yet Comey, and the rest of the Obama intel and law enforcement, used Hillary’s dossier as if it were factual information to go after Trump.  So, if Trump has any opinions about Comey, it’s more than justified because of all problems it caused Trump’s 2016 campaign and presidency.  Trump was eventually investigated by former Special Counsel Robert Mueller.

            Trump has made many public comments about Comey since early days of his 2016 investigation all through his presidency.  “One of the worst human beings this Country has every been exposed to is James Comey, the former Corrupt Head of the FBI,” Trump wrote on Truth Social,” last Thursday.  “Today he was indicted by a Grand Jury on two felony counts for various illegal and unlawful acts.  He has been so bad for our Country, four so long, and is now at the beginning of being held responsible for his crimes against our Nation.  MAKE AMERICA GREAT AGAIN!” Trump wrote of Truth Social.  Yet sympathetic former federal prosecutors think Trump’s public remarks make the case for selective or vindictive prosecution.  Trump has been very transparent in what he thinks about Comey for years.  No judge can toss out a case purely for Trump sharing his true feelings.

            Making a case for selective or vindictive prosecution isn’t easy for defense attorneys, no matter what Trump has put on the record.  “This case is also notable because this isn’t just a question of the motive of the specific prosecutor who brought the charges,” said Gene Rossi a former federal prosecutor.  “It’s also about the president’s decisions to speak publicly about a case that’s a high-profile political case,” saying Trump made the case for malicious prosecution.  Comey committed far worse crimes than the ones for which he’s been charged.  When FBI Director, he authorized his office to leak regular fake stories to the New York Time and Washington Post, promoting a false narrative against Trump.  Whatever Trump said publicly about Comey, it pales in comparison to Comey violating the public trust, using his office go after Trump purely for politics.
