Things looked good for 74-year-old President Donald Trump late last night until the counting of mail-in ballots continued reversing his fortunes in Wisconsin and Michigan, two must-win states, when you consider Trump lost Arizona and Nevada. Calling for recounts won’t change the vote totals now for 77-year-old former Vice President Joe Biden, looking like he’ll eventually be declared winner. While Trump presses for recounts, he had his shot in both states but came up short because Covid-19 proved a successful campaign strategy for Democrats. Blaming Trump for the virus, unfair as it is, resonated with voters, who thought they had enough of the novel coronavirus continuing to wreak havoc on the American way of life. Prospects of more shutdowns got a lot higher with Biden, who’s signaled he plans to follow “scientists” recommendations even if it tanks the economy.
Trump worked hard with Senate Majority Leader Mitch McConnell (R-Ky.) to confirm Associate Justice Amy Coney Barrett on the court in case of a disputed election. But disputing an election isn’t enough for Trump if Biden wins 270-or-more Electoral votes, something that looks guaranteed. No one on the Supreme Court counts the ballots, whether counted on Nov. 3 or any other day. Giving the sheer volume of mail-in ballots, the Supreme Court knows the state election officials can’t get everything done on Nov. 3. Trump’s argument about counting ballots after Nov. 3 won’t move anyone of the Supreme Court, knowing that delays were already baked into the cake. Arguing for recounts in states with clear Biden majorities won’t change anything unless Trump’s lawyers can prove fraud. Trump campaign manager Justin Clark accused Democrats of “scheming” to “disenfranchise and dilute” Republican votes.
Things would be a lot different for Trump if he held Arizona, Nevada, Wisconsin and Michigan. Letting those state slip to Biden, whom Trump called the worst candidate in history, puts Biden over the 270 Electoral vote threshold. “Pennsylvania’s unhinged, radical left Secretary of State Kathy Bookvar has tried her hard to bake in a back door to victory for Joe Ben with late, illegal ballots in collusion with the partisan state supreme court,” said Clark. But as much as Trump wants to cry foul, there’s zero evidence that anything illegal went down. Counting late votes was expected in the Covid-19 era, nothing that should automatically conclude fraud. While fraud might exist, it’s going to be tough to prove, without supervised recounting, going through ballots to see whether or not they were legitimate. Whatever happed with Bush v. Gore in 2000, Biden v. Trump could be far worse.
Claiming the federal election rules prohibit counting after Election Day is something left to individual state election officials. “The United States Constitution is clear on the issue: the legislature sees its the time, place, and manner in America, not state courts or executive officials,” Clark said, defending Trump’s right to contest. But federal district court, courts of appeals or Supreme Court are not in a position to dictate to states how to run elections, especially in the Covid-19 era, an extenuating circumstance adding to mail-in vote totals, requiring extra time to count ballots. Accusing state officials without proof of harvesting more ballots isn’t supported by facts in evidence, not something the courts would take seriously. Whatever one state, like Minnesota, did to require ballots on Election Day, doesn’t mean that the same rule applies to all states with different circumstances.
Lawsuits over the manner in which ballots were counted or demanding recounts isn’t likely to change the vote or the outcome. “Without our action, Pennsylvanians, as possibly all Americans, may be forced to wait yet another several days for the outcome of the election—all because of the Secretary’s ridiculous 11-th hour guidance that directly violates the Election Code,” Clark said. But with Covid-19 looming over everything in 2020, not court’s going to hold election officials to the same standards in the pre-Covid era. Losing major battleground states were Trump’s Achilles Heel, predicted by pollsters before the election. While it’s difficult to think you’re winning then watch your lead evaporate because more votes were counted doesn’t constitute election fraud, unless the Trump campaign can show proof. Courts aren’t likely to accept claims of fraud without some measure of proof.
Trump did a heroic job campaigning for a second term. No one can say he didn’t leave it on the field, battling the corrupt U.S. media that did everything possible to get Biden elected. Never before in U.S. history did the Free Press censor a legitimate news story about Joe Biden and his family’s corruption, with plenty of evidence to prove wrongdoing. While reported on Fox New and in the New York Post, the tale of Hunter Biden’s business partner Tony Bobulinski, testifying that Joe Biden was involved with Hunter’s overseas deals in China, Russian and Ukrane, was censored, completely erased in the mainstream broadcast and print media to protect Biden’s chances of winning. Accepting Trump losing is one thing but accepting Joe Biden as president is hard to swallow. If the GOP Senate retains it majority, Biden should immediately come under a Special Counsel investigation.
